Cabinet clarifies procurement criteria for Ukraine Facility funds

The Cabinet of Ministers of Ukraine has approved a new section in the rules for public procurement during martial law, which regulates how customers can use funds from the Ukraine Facility program from the European Union.
According to information on the website of the Ministry of Economy, Environment and Agriculture of Ukraine on Monday, the new section determines that only companies and subcontractors registered in "eligible countries" - EU states, Ukraine, Western Balkan countries, Georgia, Moldova, countries of the European Economic Area, as well as in other countries that, according to the European Commission, provide Ukraine with a level of support at the level of EU support - can participate in the procedures.
It also determines that the new section provides the opportunity to participate in the procedures for all goods, including within the framework of works and services, but they must also originate from these countries. At the same time, participants and their beneficial owners must not be under EU sanctions.
The Ministry of Economy explained that the coordination of the procedure with the obligations under the Framework Agreement between Ukraine and the EU on the functioning of the Ukraine Facility program makes the procurement system more understandable and increases the efficiency of using EU funds for recovery and development. This applies to all public procurements for program funds - from authorities and local communities to educational, healthcare and other state and municipal institutions.
The Ukraine Facility program was launched in 2024 by a decision of the European Parliament and the Council of the EU. Its goal is to help Ukraine with financing recovery, modernization and reforms on the path to EU membership, the amount of support is EUR50 billion for 2024-2027.
